This website (the “Site”) is owned and operated by Sonny English (“Company,” “we” or “us”). By using the Site, you agree to be bound by these Terms of Service and to use the Site in accordance with these Terms of Service, our Privacy Policy, our Copyright Policy and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site or from the Company. Accessing the Site, in any manner, whether automated or otherwise, constitutes use of the Site and your agreement to be bound by these Terms of Service.
We reserve the right to change these Terms of Service or to impose new conditions on use of the Site, from time to time, in which case we will post the revised Terms of Service on this website. By continuing to use the Site after we post any such changes, you accept the Terms of Service as modified.
By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.
If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law.
Intellectual Property Rights
This Site and all the materials available on the Site are the property of us and are protected by copyright, trademark, and other intellectual property laws. The Site is provided solely for your personal noncommercial use. You may not use the Site, or the materials available on the Site, in a manner that constitutes an infringement of our rights or that has not been authorized by us. You may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material from the Site. You may, however, from time to time, download and/or print one copy of individual pages of the Site for your personal, noncommercial use, provided that you keep intact all copyright and other proprietary notices.
Paid Programs – Single Usage Rights
IMPORTANT: If you join any of our paid courses, the fee you pay is to educate one person. You are not permitted to share your login with anybody else. You are permitted to access the content from up to three devices of which no more than two can be tablet or desktop devices. We may use IP tracking software, pixels or cookies that tracks every individual login to our paid content and the email address associated with the account that paid for the course. This software tracks the date, time, location, device type, email address of paid account, what kind of device was used, the browser used and all content viewed. If a breach of contract occurs as a result of more than 3 devices or more than 2 desktop or tablet devices accessing your account, your account may be immediately suspended or blocked permanently depending on the outcome of an investigation into the matter. In essence, buying access to any of our paid content is for one person only, not as many people as you care to share your logins with.
Limitations on Linking and Framing.
You may establish a hypertext link to the Site as long as the link does not state or imply any sponsorship of your site by us or by the Site. You may not, however, without our prior written permission, frame or inline link any of the content of the Site, or incorporate into another website or other service any of our material, content or intellectual property.
Company Proprietary Rights
Under the terms of this agreement, you expressly acknowledge, accept, and agree that any software, tools, content or files used in connection with the services provided by Sonny English contains proprietary, copyrighted and confidential information that is protected by applicable intellectual property and other laws. You expressly acknowledge, accept, and agree that the Content contained in sponsor advertisements or information presented to you through the services or advertisers is protected by copyrights, trademarks, service marks, patents, or other proprietary rights and laws. You also expressly acknowledge, accept, and agree that unless expressly authorized by Sonny English or advertisers not to modify, rent, lease, loan, sell, distribute, or create derivative works based on those aforementioned services, software, tools, files or content in whole or in any part thereof. You also expressly acknowledge that any downloading or streaming of course content for possible distribution is strictly prohibited. You understand that by making any attempts to circumvent the educational processes in place (such as bypassing approval processes, progress updates, exams, assignments, etc.) for the sole purpose of obtaining direct download access to Sonny English’s copyrighted material is not the way this educational service is intended to be used, is not supported, and may result in immediate account suspension / termination without prior notice.
Limited Rights to use Content
All materials displayed on the online course (“Content”) belong to us. Members are permitted to:
- Retrieve and display the Content on a computer screen in order to use the Service for their own personal use; and
- Print individual pages on paper and store individual pages in electronic form on disk and on their computer.
Members are not permitted to:
- Redistribute any of the Content (including by using it as part of any library, archive or similar service);
- Retrieve and display or print the Content for anyone;
- Remove copyright or trade mark notices from any copies of the Content made under this Agreement;
- Create a database in electronic or structured manual form by downloading and storing all or any of the Content; or
- Modify, reproduce, publish or in any way commercially exploit any of the Content.
Nor may you permit or enable a third party to do any of these acts on your behalf.
Right to Suspend Services
Sonny English may suspend Subscriber’s or any Member’s use of the Services if Sonny English reasonably and in good faith believes such suspension is necessary to prevent unauthorized use of the Services or to prevent an ongoing violation of any applicable laws or regulations. Sonny English will use commercially reasonable efforts to notify Subscriber or Member prior to any such suspension and will only suspend the Services to the extent necessary to prevent such unauthorized use or violation. In addition, if Subscriber fails to timely pay any fees in accordance with the terms of this Agreement and/or any Service Order, Sonny English may, without limitation to any of its other rights or remedies, suspend performance of the Services until it receives all amounts due.
Subscription Plan
By subscribing to our Services you are agreeing to pay recurring periodic subscriptions for an indefinite time until cancelled by you, on the subscription terms set out in the application form you have completed. You can cancel your subscription at any time. You will not be charged for any cancellation. You can re-subscribe at any time following your cancellation, but we reserve the right not to permit re-subscription where we have previously elected to terminate a subscription by you.
Subscription Cancellation
If you wish to cancel your monthly subscription with us, you must cancel 7 days before your next payment is due to be collected. Subscribers cancelling after their payment has been taken will receive another month access. If your payment has been cancelled before the 7 day period this will avoid being charged for another month.
Private Lesson Cancelation Policy
If you reschedule your lesson for a different time or date, you will not lose that lesson fee – this lesson fee will be transferred to the new time or date for no added cost. However, you must meet these conditions:
- You must email me to reschedule the lesson.
- You must send this email a minimum of 6 hours before the lesson is due to start.
You may only reschedule a lesson twice. If you cannot make your second rescheduled lesson (third overall lesson), your lesson will be cancelled and you will lose that lesson fee and a refund will not be given.
If you do not reschedule your lesson a minimum of 6 hours before your lesson is due to start, your lesson will be cancelled and you will not receive a refund.
Teacher Cancelation
On very rare occurrences, such as an emergency or an illness, I may be unable to teach your lesson. If this ever happens, I will try to give you at least 24 hours notice but you must accept that this can occasionally happen on the day of the lesson itself. In cases where I cannot teach the scheduled lesson, the lesson will be rescheduled.
Lesson Times
You must be on time for your lessons. I will wait a maximum of 10 minutes for you to come to your class. If you have not arrived within 10 minutes, your lesson will be cancelled and you will not receive a refund. The lesson will run for one hour from the time it was due to start. If you arrive 10 minutes late, you will lose 10 minutes from your lesson and only have 50 minutes.
Refund Policy
We offer digital content that can be consumed instantly after a purchase has been made. There is no “trial” or “grace period” after purchasing any product which means all sales are final. Once you have purchased the content, there is no way to “return” it. Refunds will not be provided.
Exam Results:
I pride myself on my ability to help students get the scores they require in order to achieve their specific goals. A great amount of effort is put into crafting each and every lesson with the target of preparing students for everything the PTE exam might throw at them, and giving them the tools and techniques to boost their chances of success.
However, despite best efforts, sometimes results do not meet expectations. When you commit to lessons with Sonny English, you accept that Sonny English does not take any responsibility for a disappointing score, and that there can be no refunds.
